General Terms and Conditions (GTC) – Studio Arca

1. Scope of Application These General Terms and Conditions (hereinafter "GTC") apply to all purchase contracts, services, and deliveries concluded via the online shop (Shopify) or directly on-site between Studio Arca (hereinafter "Seller") and the customer (hereinafter "Buyer"). By ordering or purchasing, the Buyer acknowledges these GTC.
2. Conclusion of Contract The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the button [Buy / Send Order], the Buyer submits a binding order for the goods contained in the shopping cart. The contract is concluded when the Seller accepts the order by providing an order confirmation via email.
3. Specifics of Vintage Goods (Condition)  3.1. The Buyer is aware that the products offered are predominantly used vintage objects (design classics). 3.2. Age-related signs of use (patina, small scratches, discoloration) are characteristic of these goods and do not constitute a defect. 3.3. The Seller endeavors to provide a truthful description and documentation of the condition. The images in the online shop are part of the product description.
4. Prices and Payment  4.1. All prices are in Swiss Francs (CHF). 4.2. Since Studio Arca may be subject to differential taxation (for used items), VAT is often not shown separately on the invoice (according to Art. 24a MWSTG). 4.3. Payment is made via the payment methods offered in the shop (credit card, TWINT, etc.) or by prepayment.
5. Delivery and Shipping  5.1. Delivery is made to the address provided by the Buyer within Switzerland (international upon request). 5.2. Shipping costs are shown separately in the ordering process. For freight goods (large furniture), delivery is often only "to the curb," unless otherwise agreed. 5.3. Benefit and risk pass to the Buyer upon shipment of the goods (Art. 185 OR).
6. Right of Withdrawal and Return  6.1. Under Swiss law, there is no statutory right of withdrawal for online purchases. 6.2. However, Studio Arca grants a voluntary return period of 14 days, provided the goods are returned in the exact same condition as at the time of purchase. The costs for return shipping (in particular freight costs for furniture) are borne entirely by the Buyer. 6.3. Excluded from the right of return are products that were restored on behalf of the customer or individually manufactured using 3D printing.
7. Warranty (Guarantee)  7.1. For used goods, the statutory warranty is completely excluded to the extent legally permissible (Art. 199 OR), unless a functional guarantee (e.g., for electronics/lights) was expressly given. 7.2. However, the Seller is liable for intentionally concealed defects. 7.3. The Buyer is obliged to inspect the goods immediately upon receipt and to report any transport damage or obvious defects in writing within 48 hours.
8. 3D-Printed Components and Repairs For components manufactured by means of 3D printing, the Seller assumes no liability for load capacity beyond normal use. These parts primarily serve the aesthetic restoration of the original function.
9. Retention of Title The delivered goods remain the property of Studio Arca until full payment has been made. If the Buyer is in default with the collection of the goods, Studio Arca is entitled to charge a storage fee of CHF 10.00 per calendar day starting from the 15th day. Ownership only passes to the Buyer after full payment of the purchase price including any storage fees.
10. Liability Liability for slight negligence as well as for indirect damage or consequential damage is excluded.
11. Jurisdiction and Applicable Law  Swiss law is exclusively applicable to the contracts. The place of performance and jurisdiction is the registered office of Studio Arca [Basel Stadt].
